Contract Preparation & Negotiation.  We assist clients with contract negotiations, contract preparation, and structuring procurement arrangements.  The knowledge gained from our litigation experience is invaluable in drafting and negotiating contracts that serve to properly protect our clients’ rights in the event that litigation occurs or to craft language to help avoid a dispute from developing in the first place.  Our experience includes contracts for use in a variety of project delivery methods and payment structures, including design-bid-build, design-build, fixed-price, GMAX, and cost-reimbursable contracts.

Contract Administration.  Our contract administration services typically involve the investigation and resolution of minor issues to the extent they arise during a construction project — and before such issues become major issues. Our early and continuing involvement as a project progresses assures appropriate project document and contract compliance, enabling clients to make informed decisions consistent with contractual requirements and their business objectives — and help avoid claims and litigation in the future. 

Claims and Dispute Resolution.  From preliminary negotiations through trial and appeal, our lawyers have considerable experience litigating construction disputes in federal and state courts throughout the United States, as well as via arbitration under the auspices of the American Arbitration Association and other arbitration tribunals.  We work with leading consultants to develop critical path analyses and use appropriate damages analyses to support or defend delay, disruption, lost productivity, extra work, differing site conditions and other types of construction claims. Because our clients’ success often rests on our ability to implement thoughtful, cost-effective solutions, we commonly focus our efforts on strategic counseling and alternative dispute resolution in order to increase our clients’ chances of an early and successful resolution of the dispute. We are experienced in a broad range of alternative dispute resolution (ADR) techniques, including mediations and binding/non-binding arbitrations.  Our lawyers are also experienced in Miller Act litigation on behalf of sureties, prime contractors, subcontractors, and suppliers.
